Terms of Service

These terms are between you and VelvetAPI (“we”). By creating an account or using the API you accept them, the Acceptable Use Policy and the Privacy Policy.

Accounts

You must be 18 or older and give accurate account details. You’re responsible for your API keys and for everything done with them, including your end users’ requests. Keep keys on your servers, never in client-side code.

Prepaid credits

• Generations are paid from a prepaid USD balance at the prices published on each model’s page. A request’s price is held when it’s accepted and charged when it succeeds.
• Failed, cancelled, refused and withheld requests aren’t charged.
• Top-ups don’t expire. They aren’t refundable as cash except where the law requires or where we close your account without cause.
• We may change prices with notice on the pricing page. Changes don’t affect requests already accepted.

Your content

You own the prompts you send and, as far as the law allows, the images you generate, subject to the license of the model that made them (listed on each model’s page). You grant us the rights we need to run the service: processing your requests, storing outputs for 14 days, and screening and keeping content for safety and legal compliance. We don’t train models on your data.

Acceptable use and enforcement

You must follow the Acceptable Use Policy. We may refuse requests, withhold outputs, suspend end users or accounts, and report to authorities when the policy or the law requires it. If we close your account for a serious violation, your remaining balance may be forfeited to the extent the law allows.

Availability

The service is provided “as is”. We aim for high availability but don’t promise it, and models may change or be retired with notice.

Liability

To the extent the law allows, our total liability for any claim is limited to what you paid us in the three months before it. We aren’t liable for indirect or consequential losses. You’ll indemnify us against claims arising from your content, your end users’ requests, or your breach of these terms.

Changes and termination

We may update these terms with 14 days’ notice by email or in the console. You can stop using the service at any time, and we can end the agreement with notice, or immediately for serious violations.
